According to the Utah Courts, there are limited reasons why an annulment may be granted. They include:

  • The marriage occurred under fraud or misrepresentation.
  • One of the parties is still married to someone else.
  • One of the parties was under the age of 16.
  • One of the parties was under the age of 18 and did not obtain parental consent.
  • The marriage occurred between close relatives.

An annulment is one way to solve the issue your family is facing. It can be beneficial in that after an annulment is granted, it is as if the marriage never happened. With a divorce, your property is subject to division, and this means that you could lose important items to your spouse, such as retirement, money in savings accounts and other items of monetary value.

In regards to legal separation, you and your spouse will be allowed to live separately but your marriage will not legally end. One of the big differences between legal separation and annulment is that with an annulment, you would be free to remarry, and with a legal separation you cannot. Additionally, a legal separation may still entitle you to seek or receive spousal support and certain property rights while an annulment would eliminate those choices.
