Comprehensive Bankruptcy Law Services in Utah

Navigating the complex landscape of Utah bankruptcy law can be a challenging feat. Here at our renowned bankruptcy law firm, we strive to simplify the process for you, offering a comprehensive suite of services designed to tackle various financial crises. Our commitment as your trusted Utah bankruptcy attorney is to ensure that you receive the best advice and representation.

Chapter 7 Bankruptcy

This form of bankruptcy, also known as liquidation bankruptcy, is the most commonly filed type of personal bankruptcy in bankruptcy court. In a Chapter 7 bankruptcy, a bankruptcy trustee is assigned to sell off your non-exempt assets to repay your debts. However, the intricacies of what constitutes an exempt or non-exempt asset can be confusing, which is why our top Utah bankruptcy lawyers are here to guide you through the process. We help you understand whether Chapter 7 bankruptcy is the right choice for you, given your specific financial circumstances, and work diligently to safeguard your essential assets.

Chapter 13 Bankruptcy

Unlike Chapter 7, Chapter 13 bankruptcy involves developing a repayment plan to pay off some or all of your debts over a period of three to five years. The advantage of Chapter 13 is that it can help protect your assets from liquidation, which may occur in a Chapter 7 bankruptcy. Our bankruptcy law attorneys specialize in creating robust repayment plans that comply with the law while ensuring your family has financial stability.

Business Bankruptcy

Every business goes through periods of financial uncertainty. Whether it’s a struggling startup or a well-established corporation, bankruptcy can be a strategic decision to overcome financial obstacles. As experienced bankruptcy attorneys, we are adept at navigating through Chapter 11 bankruptcy, which is designed specifically for businesses with financial difficulties, offering them an opportunity to restructure their debt while remaining operational.

Personal Bankruptcy

Personal bankruptcy cases can arise from a myriad of circumstances – unexpected medical bills, credit card debt, job loss, or other personal financial hardships. Regardless of the cause, our firm is here to help you understand your options and guide you through the personal bankruptcy process, providing you the support you need to regain control of your financial situation.

Debt Relief

Debt can be overwhelming, and sometimes, filing for bankruptcy may not be the most suitable course of action for you. Our bankruptcy law office is equipped to provide a wide range of debt relief solutions, from debt consolidation and settlement to negotiating with creditors on your behalf eliminating debt further. We are committed to helping you reduce or eliminate your debts, providing you a path towards financial freedom.

Foreclosure Defense

The threat of losing your home to foreclosure can be a terrifying prospect. Our experienced attorneys offer strong foreclosure defense services, helping you explore legal avenues to keep your home or mitigate the impacts of foreclosure.

Creditor Representation

Bankruptcy law doesn’t solely cater to debtors. If you’re a creditor caught in a bankruptcy case, our attorneys can represent your interests. We strive to ensure your rights are upheld in court, and that you recover the maximum amount possible from the bankruptcy estate.

Frequently Asked Questions About Bankruptcy Law

As the best bankruptcy attorney in Utah, we believe that knowledge is power. Understanding the legal processes surrounding Utah bankruptcy is crucial for making informed decisions. We’ve compiled some frequently asked questions and their answers to provide you with some clarity on the subject.

1. What is bankruptcy and how does it work?

Bankruptcy is a legal process in bankruptcy court that helps individuals or businesses who are unable to pay their debts to seek relief and possibly obtain a fresh financial start. The two most common types of bankruptcy are Chapter 7 and Chapter 13. Whether you’re considering to file bankruptcy or are simply looking for debt relief options, it’s important to understand the implications of this decision.

Chapter 7, also known as liquidation bankruptcy, allows you to eliminate most of your general unsecured debt like credit card bills and medical expenses without having to make monthly payments back to your creditors.

Chapter 13, often referred to as reorganization bankruptcy, allows you to consolidate your debts and propose a repayment plan to your creditors over a three to five-year period.

The right type of bankruptcy for you depends on your individual circumstances, including your income, assets, debts, and personal goals.

2. What types of debt can be discharged in bankruptcy?

Most types of unsecured debt, such as credit card bills, student loan debt, medical debts, certain personal loans, and utility bills, can often be discharged through bankruptcy. However, certain types of debt, including most student loans, child support, alimony, and certain tax debts, generally cannot be discharged.

3. Will I lose all my assets if I file for bankruptcy?

Not necessarily. Bankruptcy laws have exemptions that protect certain types of property. For example, under Utah bankruptcy law, you may be able to keep your home, car, and other essential assets. The specifics depend on your unique circumstances, the bankruptcy chapter you’re filing under, and the type of assets you possess.

4. Can bankruptcy stop creditor harassment and wage garnishment?

Yes. Once you file for bankruptcy, an “automatic stay” goes into effect, which prohibits most creditors from continuing with collection activities, including lawsuits, wage garnishments, and even those harassing phone calls.
